1. Terms & Conditions

 

1.1 This site is operated by HYPERFIT LTD at the location of Gransden Road, Abbotsley, PE19 6UA.

1.2 These terms and conditions include (i) general terms and conditions for the use of this site and (ii) terms and conditions relating to the services provided by HYPERFIT LTD on the site and in their fitness facility and use of the site, the purchase of any services on the site or use of the facility will be subject to these terms and conditions.

 

2. Membership Options/Bookings

 

2.1 Membership options are set out within the Memberships. Bookings for group fitness sessions may then be made through the Wix Booking App. Personal training session bookings are to be made with Victoria Strahan through the One Leisure website, by which the link can be found via the "Personal Training Enquiries" button on the HYPERFIT site homepage. Personal Training sessions are carried out at One Leisure St Neots, Barford Road, Eynesbury, St Neots, PE19 2SA unless agreed otherwise.

 

2.2 Group Training sessions are always subject to availability, though we will do our best to accommodate you. There may be waitlists for Group Training sessions. All sessions will be led by Victoria Strahan. All membership options and group sessions must be prepaid and are subject to our cancellation policy below.

 

2.3 It is a condition of acceptance of membership that the member agrees to be bound by these terms and conditions.

 

2.4 HYPERFIT LTD reserves the right (i) to reject any application for membership without giving any prior notice or (ii) to cancel any membership without notice subject to 4.3 of these terms and conditions.

 

2.5 Membership is personal to the member and cannot be transferred.

 

3. Pricing

 

3.1 Information is displayed on our Membership and Classes pages. Pricing is subject to change by HYPERFIT LTD.

 

4. Code of Conduct

 

4.1 Members are expected to behave in an orderly fashion at all times whilst in The Barn and shall be responsible for any injury they may cause to others and for any damage done to any property.  Members are also required to be aware of dogs free roaming in the yard on entry and must proceed with caution.  Failure to do so, members may be liable for any injury caused to the dogs.

 

4.2 No alcohol may be brought by members into the gym and smoking is strictly forbidden anywhere on site. In addition, members may not enter The Barn under the influence of alcohol or bring into The Barn any non-prescription drugs or illegal substances.

 

4.3 Failure by any member to comply with these terms and conditions including this code of conduct will entitle HYPERFIT LTD to terminate a member’s membership without refund.

 

5. Cancellation/Refund Policy

 

5.1 Payment for all sessions and group training must be made in accordance with the relevant Membership or PT package option and prior to any sessions booked and conducted.

 

5.2 Cancellations for any group sessions need to be made 2 hours before a class starts; any cancellation within 2 hours of any group session see that allocated session forfeited from the members allocation.

5.3 Pre-paid classes and/or packages are non refundable, however in the event the Coach cannot fulfil any class, the member's place can be transferred to another class.

 

6. Suspension of service

 

6.1 HYPERFIT LTD will use their reasonable endeavours to ensure The Barn is open and all equipment is in working order and available for use by members during times as set out on our Timetable. There may be occasions, however, when The Barn may be closed or the Coach may not be available for reasons beyond our control as, for example, for essential maintenance purposes or illness of the Coach.

 

6.2 HYPERFIT LTD may suspend the operation of this site for maintenance, renovation or repairs.

 

6.3 HYPERFIT LTD reserves the right to reduce the number of sessions over Bank Holidays and the Christmas/New Year period, and in the case of the Coach taking annual leave.

 

7. Due care

 

7.1 Any training provided by HYPERFIT LTD will be carried out with all due care and attention, and within the scope of the relevant qualifications obtained by the Coach.

 

8. Disclaimer of Liability

 

8.1 All members use the gym at their own risk. Neither HYPERFIT LTD nor it's Coach or Landlord shall be liable for;

8.1.1 the death or personal injury of any member whilst in or using the gym except to the extent that death or personal injury arises from any negligent act or omission of HYPERFIT LTD  or any agent or employee thereof; or

8.1.2 any loss, damage to or theft of personal property belonging to the member occurring in the gym

 

8.2 It is all member’s responsibility to determine that they are fit and well before attending any sessions or group training and members are advised to undergo a medical examination prior to beginning any physical activity programme. In addition, all Members must complete a PAR-Q Form via the online booking software upon booking their first session or taking out a Membership package/program.

 

9. General

 

9.1 HYPERFIT LTD may change these terms and conditions from time to time and by browsing the site you are accepting that you are bound by the current terms and conditions which form the entire understanding of the parties and supersede any previous agreements, understanding and representations

 

9.2 These terms and conditions shall be governed by and interpreted in accordance with English law. 

 

9.3 You may not pause a package whilst on holiday or ill. Where circumstances mean you will be unable to train for a long period of time, we would need suitable proof in the form of a doctors/hospital letter to be able to put your membership on hold. Under no circumstances are you to let anyone else use your membership.

 

9.4 In order to use The Barn you must be confident and competent to use the equipment safely without causing damage to the property or equipment or harm to yourself or other people within the facility.  Any improper use of the gym and it's equipment will be deemed a breach of contract and will be followed up with the appropriate actions.  If you have any issues with your membership or are unsure which is correct for you please see Victoria Strahan for more information.

 

9.5 Security cameras are in place with monitored access and usage by Hilltop Retreat to ensure the safety of our members and other businesses/persons within the premises.

 

9.6 For safety reasons, bags and coats are to be stored in the designated area and correct attire must be worn when exercising i.e. suitable comfortable exercise clothing and appropriate footwear. Clothing such as jeans, boots, flip-flops/sandals or work wear are not permitted. You may not attend The Barn whilst under the influence of alcohol, narcotics, tranquilisers or any medication or other substance which may affect your ability to exercise safely.  HYPERFIT LTD reserves the right to remove you from the premises if it reasonable believes you are unfit to use the facilities.

 

9.7 Weights and equipment are to be put back in their original place in the storage room when finished, repeated failure to do so may result in your membership being terminated.  Please do not misuse the weights by dropping them on the floor, failure to do so may result in your membership being terminated. 

 

9.8 Photographs and videos may be obtained for social media advertisement; please make clear to HYPERFIT LTD if you do not wish to be tagged / included in advertisements or any social media.

 

9.9 You must not behave in an aggressive, abusive, anti-social or threatening manner to any persons on the premises, any one doing so will have their membership terminated immediately and HYPERFIT LTD reserves the right to contact the Police if deemed necessary.

 

9.10 Members must inform HYPERFIT LTD via email of any change of contact and email address or telephone numbers. These changes can also be made in the Members login area of the Wix booking system.

 

9.11 By accessing The Barn and using the gym equipment members are deemed to have read and understood the terms and conditions of membership.  Should your Physical Activity Readiness Questionnaire result in you being required to discuss your intention to exercise with your doctor, please be aware that your subscription remains active and any fees collected are non-refundable.

 

9.12 Members must arrive promptly for class start times, consistent late arrival may result in being refused entry to the class.  If you can’t make a class, please cancel it online or in our app. You may lose your booking rights if you forget to cancel on a regular basis.
